Welcome to MarkX AI Labs. These Terms of Service govern your access to and use of the MarkX AI Labs platform ("MKX-OS"), including our website, AI products and modules, and the EDITH trading dashboard. By accessing or using any part of the services, you agree to be bound by these Terms. If you do not agree, please do not use the services.

Please read these Terms carefully. They are written in plain, professional language and describe the rules that apply when you use what we offer.

The services are intended for adults. You must be at least 18 years old, and able to form a binding agreement, to create an account or use the services. By using the services you represent that you meet these requirements.

Some features require an account. You are responsible for the information associated with your account, for keeping your login credentials confidential, and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that are used in a way we reasonably consider harmful.

MarkX AI Labs is an AI research lab and platform. We provide AI products and modules, informational content (such as our home, about, and blog pages), a contact channel, and a multi-tenant trading dashboard called EDITH.

EDITH lets authorized client users connect and operate their own FreqTrade cryptocurrency-trading servers through the platform. MKX-OS acts as an interface to servers, strategies, and funds that you own and control. We may add, change, or remove features over time as the platform evolves.

MarkX AI Labs does not guarantee any profit, return, or trading outcome. Markets are volatile and unpredictable, and past performance is never a guarantee of future results. You trade entirely at your own risk and are solely responsible for your own decisions.

You are responsible for your own trading servers, strategies, configurations, funds, API keys, and for complying with any laws and rules that apply to your trading activity. Before trading, consider seeking advice from a qualified, independent professional.

You agree to use the services lawfully and responsibly. You will not:

• Break any applicable law or regulation, or use the services to facilitate unlawful activity.
• Attempt to gain unauthorized access to the platform, other users’ accounts, or any connected systems.
• Interfere with, disrupt, overload, or probe the services, our infrastructure, or our security controls.
• Reverse engineer, scrape, or attempt to extract source code except where such restriction is prohibited by law.
• Upload or transmit malicious code, or use the services to harass, defraud, or harm others.
• Misrepresent your identity or your authority to connect a given trading server or account.

We use automated security measures (including rate limiting, bot detection, and a web application firewall) to protect the platform, and we may restrict or block activity that appears abusive.

When you connect a trading server through EDITH, you remain in control of, and responsible for, that server and everything associated with it. This includes:

• The trading server you connect, including its configuration, uptime, and security.
• The funds, exchange accounts, and API credentials you use with it.
• The trading strategies you run and the decisions and outcomes that result.
• Keeping your own credentials and connection details accurate and secure.

You agree that MarkX AI Labs is not responsible for losses arising from your own servers, strategies, credentials, or trading decisions.

The MKX-OS platform, including its software, design, interfaces, text, graphics, and the MarkX AI Labs name and branding, is owned by MarkX AI Labs or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the services for their intended purpose.

You retain ownership of the content and configurations you provide. You keep all rights to your own trading servers, strategies, and funds — connecting them to the platform does not transfer ownership to us. You may not copy, modify, distribute, or create derivative works from the platform except as expressly permitted.

The platform relies on third-party service providers to operate (for example, application hosting, database hosting, security, and error monitoring), and it interacts with third-party systems that you choose to connect, such as your own FreqTrade server and any cryptocurrency exchanges you use.

We do not control those third-party systems and are not responsible for their availability, content, terms, or conduct. Your use of any third-party service is governed by that provider’s own terms.

The services are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by applicable law. We do not warrant that the services will be uninterrupted, error-free, secure, or that they will meet your requirements or produce any particular result.

While we apply industry-standard security measures, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

To the fullest extent permitted by applicable law, MarkX AI Labs and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, funds, data, or trading opportunities, arising out of or relating to your use of the services — including any trading activity conducted through EDITH.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold harmless MarkX AI Labs and its team from and against any claims, losses, liabilities, and reasonable expenses arising out of your use of the services, your trading activity, your violation of these Terms, or your violation of any law or the rights of a third party.

You may stop using the services at any time. We may suspend or terminate your access if you breach these Terms, if we reasonably believe your use poses a risk to the platform or others, or if we discontinue the services.

Provisions that by their nature should survive termination — such as intellectual-property, disclaimers, limitation of liability, and indemnification — will continue to apply.

We may update these Terms from time to time as the platform evolves. When we do, we will revise the "Last updated" date shown at the top of this document. Your continued use of the services after changes take effect constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
